If you are on a vessel using motor or engine propullsion and you see another vessel's green side light, that means you should Stand On (hold a steady course and speed) and they should Give Way (maneuver clear of your ship).
If it becomes obvious the other vessel is not going to move, the Rules of the Road state that you need to do whatever is nesessary to avoid collision, including breaking the rule to Stand On.
If you took no action or took the wrong action prior to a collision, both vessels will be at fault.
